Austin's Pool Code: What It Requires
Texas sets no statewide barrier rule for homes. What it does, through Local Government Code 214.103, is hand every pool-regulating city the ISPSC as a default and let it move to a newer edition (Local Government Code 214.103). Austin has done that twice: on June 4, 2020 the City Council adopted the 2018 edition (city FAQ), and on April 10, 2025 it replaced it with the 2024 ISPSC and local amendments (Ordinance 20250410-043), effective July 10, 2025.
The 2024 barrier section (Section 305) sets this baseline for a residential pool:
- A barrier top at least 48 inches above grade on the side away from the pool
- Bottom clearance no more than 2 inches over grass or gravel, or 4 inches over a solid surface such as concrete
- No opening that passes a 4-inch sphere
- Pedestrian gates that open outward, self-close and self-latch
- Where a house wall is part of the barrier, alarms or another approved protection on the doors and windows that open onto the pool
- Construction fencing at least 4 feet tall around an in-ground pool site from excavation until the permanent barrier is finished
- An exception for a pool with a powered safety cover meeting ASTM F1346, a standard from ASTM International (ASTM)
Austin's fencing rules add that a fence used as a pool barrier must follow the Swimming Pool and Spa Code in City Code Chapter 25-12, Article 14. Chapter 757 of the Health and Safety Code covers apartment and HOA pools, not single-family homes.
Who Permits Your Pool in the Austin Area
Inside and outside city limits the state position is identical. The difference is which local body, if any, adds a rule.
