Houston Pool Fence Requirements at a Glance
No Texas statute requires a barrier around a single-family pool. Where a city regulates pools, Local Government Code §214.103 makes the International Swimming Pool and Spa Code (ISPSC) its default pool code, and cities may adopt a newer edition. Houston adopted the 2021 ISPSC. The state enclosure law in Health and Safety Code Chapter 757 covers apartment complexes and property owners association pools, not private backyards.
Houston Pool Barrier Requirements
Houston's 2021 ISPSC barrier rules (Section 305) set this baseline for a residential pool. The Houston Permitting Center's code change summary highlights the local points marked below.
- At least 48 inches high, measured on the side away from the pool
- A bottom gap of no more than 2 inches over soil or grass
- No opening a 4-inch sphere can pass through
- Gates that open outward, self-close and self-latch. If the latch release is less than 54 inches up, it must sit on the pool side at least 3 inches below the top of the gate
- Where the house forms part of the barrier: door alarms, self-closing doors, a powered safety cover, or another approved means
- Houston: a pool with a powered safety cover meeting ASTM F1346 is excepted from the barrier (305.1)
- Houston: a mesh fence must sit at least 20 inches from the water (305.2.4.1)
- Houston: a 36-inch clear zone between the barrier and pool equipment outside it, so the equipment cannot be used to climb over (305.2.9)
Houston City Code: The Enclosure Has to Stay Up
Houston has its own pool chapter on top of the construction code. Section 43-33 of the City Code says the operator of a residential pool or spa must keep it enclosed at all times by a permanent fence, wall or barrier that goes all the way around. The house or an existing wall can form part of it.
Under that section the enclosure must be at least 4 feet tall with no gap wider than 4 inches, and every gate or door opening straight into the enclosure needs self-closing and self-latching hardware in its upper quarter. The house door itself is exempt from that hardware rule. Each day a violation continues counts as a separate offense.
This is a standing duty, not only a rule for new construction, so it applies to older backyard pools as well.
Houston Permit Process
The barrier is reviewed as part of the pool, not on its own fence permit:
- Pool building permit. A new pool at a home or commercial building needs a swimming pool permit, applied for through iPermits with plans uploaded to ProjectDox.
- Health Department plan approval. A new in-ground pool at a single-family home or duplex also needs residential pool plan approval from the Houston Health Department under Chapter 43. Plan review sits at 1002 Washington Ave. Above-ground pools and spas are not covered by this step.
- Fence permits. On its own, a residential fence needs a fence permit only if it is over 8 feet or built wholly or partly of masonry or concrete.
Outside city limits, ask Harris County which permits and rules apply at your address.
