El Paso Law: City Code Fills the State Gap
Texas has no statewide law that directly regulates a single-family residential pool. Health and Safety Code Chapter 757 applies only to pools owned or controlled by a multiunit rental complex or a property owners' association. El Paso sets its own rule through City Code Chapter 18.30, the city's pool and spa code. The Chapter 18.30 ordinance adopts the International Swimming Pool and Spa Code (ISPSC), 2021 edition, and the city's adopted codes list names the same edition. The ordinance's only local change is a deck-width rule; it does not amend the barrier section, so the code's own barrier rules apply:
- A barrier at least 48 inches (4 feet) high on the side away from the pool, held for 3 feet out from the barrier [ISPSC 305.2.1]
- No more than 2 inches between grade and the bottom of the barrier, or 4 inches over a solid surface such as concrete
- No opening that passes a 4-inch sphere [305.2.2]
- Pedestrian gates that open outward, close and latch on their own and can take a lock, with the latch release at least 54 inches up or on the pool side at least 3 inches below the top [305.3]
- Where a house wall forms part of the barrier: UL 2017 door and window alarms, an ASTM F1346 safety cover, or another approved means such as self-closing, self-latching doors [305.4]
Spas and hot tubs with a lockable ASTM F1346 cover, and pools with a powered ASTM F1346 cover, are exempt from the barrier rules [305.1]. The full section is in the 2021 ISPSC, Section 305. Permits run through the city's Planning and Inspections department; ask it what the barrier review and inspection require for your project.

Above-Ground Pools in El Paso
Under ISPSC 305.5, the wall of an on-ground pool can serve as the barrier where it stands at least 48 inches above grade all the way around, or where a barrier mounted on top brings it to 48 inches. Ladders or steps must be able to be secured, locked or removed, or be surrounded by a compliant barrier, and the openings they leave must not pass a 4-inch sphere. Confirm your configuration with the city before installing.

Texas leaves backyard-pool fencing to cities, and El Paso answers with the 2021 International Swimming Pool and Spa Code as written: a 48-inch barrier held for 3 feet out, outward-opening self-closing gates, and tight limits on openings and ground gaps.
The house-wall rule is the one to plan for. If your home forms part of the enclosure, a fence alone will not clear review: you need alarms on the doors and low windows, a listed safety cover, or another means the city approves. Check with Planning and Inspections before you order materials.
