Florida Law: Chapter 515's Five Safety Features

Southwest Florida pools start with the state's Residential Swimming Pool Safety Act. To pass final inspection and get a certificate of completion, a new residential pool needs one of these (F.S. 515.27(1)):

A barrier isolating the pool from the house, at least 48 inches high on the outside, with self-closing, self-latching gates that open outward
A safety cover meeting ASTM International (ASTM) standard F1346
Exit alarms on every door and window with direct access to the pool
Self-closing, self-latching devices on those doors, with the release at least 54 inches high
A pool alarm certified to ASTM F2208

Who Issues Your Permit in Southwest Florida

Which office you deal with depends on your address, and the two biggest ones now handle the barrier on a permit of its own.

Unincorporated Lee County	The county's pool permitting guide (updated October 9, 2025) says every in-ground pool, hot tub, spa or above-ground pool must be enclosed by a fence, wall, screen enclosure or other structure, and that the enclosure or fence needs its own permit. City of Cape Coral	A notice to industry (February 2, 2026) made the Safety Barrier Permit separate from the pool permit from March 1, 2026. It covers fences, screen enclosures and screen room pan roofs, needs its own site plan and construction details, and is reviewed and inspected on its own.
City of Fort Myers	A separate city. Apply to the city's building office for addresses inside city limits.
Bonita Springs, Estero, Fort Myers Beach, Sanibel	Listed by Lee County as separate municipalities in its pool guide. Each handles its own permits.

Above-Ground Pools and Screen Enclosures

Chapter 515 counts any pool holding water more than 24 inches deep, above-ground pools included. An above-ground pool's own wall can be the barrier if it meets the barrier rules, and a ladder must be removable, lockable or fenced.

Screen enclosures are common here. The building code lets a standard screen enclosure that meets the barrier rules serve as part or all of the barrier. In unincorporated Lee County, an aluminum screen enclosure permit needs drawings sealed by an architect or engineer, or a plan already mastered with the county (enclosure permit requirements).

What are the pool fence requirements in Fort Myers and Cape Coral?

State law requires one of five safety features for a new pool: a barrier, a safety cover, exit alarms, self-closing and self-latching doors, or a certified pool alarm. Lee County's permit guide goes further for unincorporated areas and requires every pool to be enclosed, on a separate fence or enclosure permit.

Does Cape Coral need a separate permit for the barrier?

Yes, since March 1, 2026. The pool permit no longer includes the barrier. The Safety Barrier Permit has its own documents, fees, review and inspection, and approving the pool does not approve the barrier.

Can a screen enclosure be my pool barrier?

It can. The Florida Building Code treats a standard screen enclosure that meets the barrier rules as a nondwelling wall that can be part or all of the barrier. Lee County permits aluminum enclosures on sealed drawings.

Do Lee County fences need hurricane-zone approvals?

Not the South Florida kind. The High-Velocity Hurricane Zone (HVHZ) in the state building code covers only Miami-Dade and Broward, so its fence product rules do not reach Lee County. Screen enclosures still need sealed drawings here.

How tall does a pool fence have to be in Fort Myers?

At least 48 inches on the outside, with no opening that passes a 4-inch sphere and gates that open outward and close and latch by themselves.

Can I pull the permit myself?

In unincorporated Lee County, yes, as an owner-builder. The county's guide says owner-builders must appear in person to sign for the building permit and must file an Owner-Builder Disclosure Statement.

Southwest Florida: Plan the Barrier as Its Own Job

The state gives you five ways to comply, but the two main offices here treat the barrier as a separate piece of work. Lee County asks for an enclosure on its own permit, and Cape Coral now reviews and inspects the barrier independently of the pool.

In practice, that means lining up the fence or cage drawings when you plan the pool, not after. If an owner-builder is pulling the county permit, budget a trip to Fort Myers to sign for it.
