Florida Chapter 515 on the First Coast

Jacksonville applies the state rule. Under F.S. 515.27(1), a new residential pool needs one safety feature to pass final inspection and get its certificate of completion. The five choices: a barrier that isolates the pool from the house and meets section 515.29, a safety cover meeting ASTM International (ASTM) standard F1346, exit alarms on every door and window that opens to the pool, self-closing and self-latching doors with the release at least 54 inches up, or a pool alarm certified to ASTM F2208.

If you pick a barrier, the Florida Building Code (FBC), Residential, section R4501.17 supplies the details: at least 48 inches high on the outside, no opening a 4-inch sphere can pass, and gates that open outward and close and latch by themselves. The Florida page has the full state rule.

Who Permits Your Pool in Duval and Nearby

Jacksonville is a consolidated city-county government, so the city's department permits most of Duval. The Beaches cities are separate municipalities with their own building offices, so check which one covers your address before you apply.

What are the pool fence requirements in Jacksonville?

Jacksonville follows Chapter 515. What form does Jacksonville ask for?

The Private Swimming Pool Safety Affirmation. The contractor's qualifier picks the safety option on it, both the qualifier and the owner sign in front of a notary, and the chosen items must be in place by final inspection. Door and window alarms must meet UL 2017.

Can my neighbor's fence be my pool barrier?

Jacksonville's form allows it if the fence meets code. The owner of the pool signs that they will install a new fence right away if the neighbor's fence is removed; otherwise the pool is out of compliance.

Is Jacksonville in the High-Velocity Hurricane Zone?

No. The Florida Building Code limits the High-Velocity Hurricane Zone (HVHZ) to Miami-Dade and Broward counties, so HVHZ fence rules do not apply in Duval.

Do the Beaches follow the same permit process?

No. Jacksonville Beach, Atlantic Beach and Neptune Beach have their own building departments. The state pool law is the same, but you apply to the city that covers your address.

Do spas and above-ground pools count?

Yes. Chapter 515 covers pools holding water more than 24 inches deep, including above-ground pools, hot tubs and nonportable spas. Jacksonville's form has extra questions for above-ground pools used as their own barrier.

Jacksonville Pool Fencing: Check the Address, Then the Affirmation

Most of Duval answers to one building department, which makes Jacksonville simpler than metros split between a city and a county. The exception is the coast: a Beaches address goes to its own city hall, so settle that first.

Then choose the safety option your contractor will sign for. The Jacksonville form is notarized by both of you, and whatever it names has to be installed before the final inspection. If you are counting on a neighbor's fence, remember the form makes its replacement your job.
