State Law, Then San Jose's Extra Layer
California's Swimming Pool Safety Act, Health and Safety Code (HSC) sections 115920 to 115929, applies when a building permit is issued for a new pool or spa, or a remodel, at a single-family home. Under HSC 115922 the pool then needs two features from a list of seven: an isolating enclosure; removable mesh meeting ASTM International (ASTM) standard F2286 with a self-closing, self-latching, lockable gate; a safety cover labeled to ASTM F1346-23; exit alarms on house doors and windows that open to the pool; self-closing, self-latching door hardware released at least 54 inches up; an ASTM F2208 pool alarm; or another lab-verified equivalent. The state lets you skip the enclosure entirely.
San Jose does not. The city's Permit Center guidance (updated April 15, 2026) says a new or remodeled pool or spa on a single-family property must be completely enclosed by a fence, wall or other durable enclosure and have at least two more drowning-prevention features. City Code Chapter 17.28 is the city's own enclosure rule.
Under Section 17.28.050, a pool 18 inches deep or more, with a building permit filed on or after May 26, 1989, must be completely enclosed by a fence, wall or other durable enclosure at least 4 feet high, set at least 4 feet from the nearest edge of the pool, with no opening over 4 inches except gates and doors. A house or other permanent building can form part of it. Gates and doors in the enclosure, including a door from the garage into the pool area, must close and latch on their own, with the device at least 3½ feet above the deck or walkway. Under Section 17.28.060, the city health officer can order an older pool enclosed if it is a hazard. The city's 4-foot figure is a local floor, not the enclosure height the state asks for.
An enclosure counted toward the state's features follows HSC 115923: at least 60 inches high, no more than 2 inches of clearance at the ground, no gap a 4-inch sphere can pass, no handholds or footholds a young child could use, and gates that open away from the pool and self-close with a latch no lower than 60 inches. That latch height is the state rule, not a San Jose addition.
Spas and hot tubs with locking safety covers meeting ASTM ES 13-89 fall outside the state Act (HSC 115925).
Permits in San Jose
Any pool or structure holding water over 18 inches deep for swimming or bathing needs a building permit in San Jose, and that includes above-ground pools, portable spas and hot tubs. The Permit Center page routes applications through SJPermits.org, with inspections scheduled online or by phone.
The enclosure and feature rule applies to remodels as well as new pools. If you pull a permit to rework an existing pool or spa, plan for the barrier to be brought up to the current rule before final.

Frequently Asked Questions
San Jose Pool Fencing: Plan for Three Layers
In most of California a pool can pass with two features and no fence. In San Jose the enclosure is fixed, and two more features go on top of it. Settle the enclosure line and the two extras before you draw plans, and check that the fence isolates the pool from the house doors.
If you are outside city limits, confirm whether your address is in another city or in unincorporated county territory, because each has its own rule.
