Palm Beach County pools answer to Chapter 515 of the Florida Statutes and to section R4501.17 of the Florida Building Code (FBC), Residential. Chapter 515 lets a new pool pass final inspection with any one of five safety features (F.S. 515.27(1)): a barrier, an approved safety cover, exit alarms on doors and windows that open to the pool, self-closing and self-latching doors, or a pool alarm certified to ASTM International (ASTM) standard F2208.

Where a barrier is used, it must be at least 48 inches high on the outside, pass no 4-inch sphere, leave no more than 2 inches at the bottom, and have outward-opening, self-closing, self-latching gates. The Act applies to new pools; our Florida page has the full state rule.

How Palm Beach County Handles Pool Barriers

The county's Building Division, which permits unincorporated Palm Beach County, runs a documented barrier process (PPM PB-O-104):

Affidavit of Understanding. Signed by the owner and the pool company's qualifier and filed with the pool application (form, rev. March 21, 2024). You pick one option: a perimeter fence, wall or screen enclosure; a yard fence with a mesh barrier or alarms between house and pool; a 360-degree mesh barrier; a screen enclosure with a mesh barrier or alarms; or an ASTM F1346 safety cover.
Barrier sub-permit. Every pool is a primary permit with a barrier sub-permit. A natural barrier may count if it meets the FBC.
Pool Barrier Agreement, only for a neighbor's fence. If part of a neighbor's wall or fence forms your barrier, you sign a Pool Barrier Agreement and record it in the county's Official Records within 10 days, as a covenant that runs with your land.

Do not fill the pool early. The county's affidavit states that filling a pool before it passes a final electrical inspection and a final barrier inspection violates the building code as amended by Palm Beach County, and that the Building Division treats it as willful.

Inside West Palm Beach. The City of West Palm Beach has its own building official (Florida Building Commission notice, 2007), so city addresses apply to the city. We have not found the city's pool barrier forms; ask whether it uses its own affidavit.

Above-Ground Pools and Screen Enclosures

Chapter 515 covers above-ground and on-ground pools deeper than 24 inches, as well as spas and hot tubs. The pool's own wall can serve as the barrier if it meets the barrier rules, with ladders or steps secured, locked or removed.

The building code lets a screen enclosure that meets the barrier rules serve as part or all of the barrier, and the county's affidavit lists a screen enclosure paired with a mesh barrier or alarms as one of its options.
