Alabama Pool Barrier Law
No Alabama statute sets a pool barrier rule for private homes. Residential building codes are enforced by the cities and counties that run permitting and inspection programs, and a county commission may adopt codes for its unincorporated areas by resolution (Ala. Code 34-14A-12).
That is changing in part. Under Act 2024-443, the Home Builders Licensure Board adopts an Alabama Residential Building Code based on the International Residential Code (IRC) (Alabama Division of Construction Management). From January 1, 2027, licensed residential home builders must build to the applicable residential code: the local code where one exists, or the Board's code where none does (Ala. Code 34-14A-12.1). Owners building their own homes are exempt from the licensing law (Ala. Code 34-14A-6). The Board's adopted text was not yet published when we checked, so we do not say whether it includes a pool barrier rule; we will re-check in January 2027.
Alabama cities and counties whose codes include the International Swimming Pool and Spa Code (ISPSC) apply its Section 305: a barrier no lower than 48 inches on the outside, no gap wider than 4 inches, and pedestrian gates that open outward, self-close and self-latch, with any low latch release moved to the pool side (ICC model text, 2024 edition).
Above-Ground Pools in Alabama
Alabama above-ground pools follow whatever the local code says. Under the ISPSC, the pool wall itself works as the barrier when it is on grade and at least 48 inches tall everywhere, and when its access ladder or steps can be removed, locked or fenced off.
