New Hampshire Pool Barrier Law
New Hampshire regulates pool barriers statewide. The state building code in RSA 155-A:1, IV adopts the 2024 International Swimming Pool and Spa Code (ISPSC) and the 2024 International Residential Code (IRC), with New Hampshire amendments, and RSA 155-A:2 requires all buildings and structures to comply with it.
The 2024 editions took effect July 1, 2026. A permit applied for before then stays under the earlier code, and through December 31, 2026 applicants may choose either edition but not mix them (Town of Amherst notice). Since the same date, towns may change the code's technical requirements only when the state code is more than two editions behind, and then neither more nor less strictly (RSA 155-A:3).
Under the ISPSC's barrier section (ICC model text, 2024 edition) call for:
- Height of 48 inches or more, measured from grade on the outside face
- A gap of 2 inches or less under the bottom edge
- Gaps too small for a 4-inch ball to pass
- Walk-through gates that swing out from the pool, shut and latch on their own, and accept a lock
- If the latch release sits lower than 54 inches on the gate, it goes on the pool side, 3 inches or more below the top, with no gap wider than 1/2 inch within 18 inches
- If the house forms one side, alarms on the doors that lead to the pool, or one of the code's other listed options
The barrier section does not apply to a pool with a powered safety cover, or a spa or hot tub with a lockable safety cover, if the cover meets ASTM F1346.

Permits & Inspection in New Hampshire
Towns that have set up local enforcement issue permits and inspect under the state code (RSA 155-A:3). Where a town has no local enforcement, state law puts separate duties on the builder (RSA 155-A:2, VI); ask the State Fire Marshal's office how that applies to a pool. Either way, the barrier rule itself is the same.
Above-Ground Pools in New Hampshire
Under the ISPSC model text, an above-ground pool wall can serve as the barrier if it meets the height rule, and a ladder or steps must be removable, lockable or surrounded by a compliant barrier (ICC). Attached decks become part of the barrier. Confirm the details with your building official.
City & Town Variations in New Hampshire
The barrier rule is the same in every town. What differs is who enforces it, and zoning rules such as setbacks, which are separate from the building code.
