Hawaii Pool Barrier Law
Hawaii has state building codes, but they reach homes through the counties. Under HRS 107-28 (Hawaii Revised Statutes), each county adopts the state codes into its own building code and may amend them without state approval. If a county has not acted within two years, the state code applies as an interim county code; the housing emergency proclamation has suspended that deadline (DAGS building code rules).
So the pool barrier rule you follow is your county's:
- Honolulu: the Revised Ordinances of Honolulu (ROH) adopt the Hawaii State Residential Code, based on the 2018 International Residential Code (IRC), with local amendments (ROH 16-1.2). ROH Chapter 16 also has its own article on residential swimming pools.
- Hawaii County (Big Island): the county residential code, Chapter 5B, adopts the 2018 IRC and keeps a residential pool barrier section, R326.3.
- Maui and Kauai counties: we have not found current barrier text in their residential codes. Ask the county building division which rule applies before you design.
Most U.S. pool rules build on the International Swimming Pool and Spa Code (ISPSC), which calls for a barrier at least 48 inches high, openings too small for a 4-inch sphere, and gates that close and latch by themselves. Use it as a starting point, then confirm your county's wording.
Permits by County in Hawaii
Each county issues its own building permits and sets its own exemptions. Ask yours whether your pool needs a permit and inspection before you buy.

Above-Ground Pools in Hawaii
Whether an above-ground pool needs a permit or a barrier, and whether its wall can serve as one, is set by your county's code. Maui County, for example, exempts small prefabricated above-ground pools from a building permit. Ask your county before you buy.
