Nebraska Pool Barrier Law
Nebraska's state building code (Neb. Rev. Stat. 71-6403) adopts the 2018 International Residential Code (IRC), except its sprinkler section and plumbing and electrical chapters. Section R326 of that code sends pools and spas to the International Swimming Pool and Spa Code (ISPSC).
Counties, cities and villages may enforce their own code only if it is the state code or one that conforms generally with it. Where a town has not adopted one within two years of an update, the state code applies there, except for construction on a farm, and it is the legally applicable code whether or not anyone enforces it (71-6406(1)(b) and (7)). A local code may amend or delete parts of the state code for reasons the statute lists, such as cost, safety or local conditions (71-6406(2)).
The ISPSC barrier rules (ICC model text, 2021 edition shown) call for:
- A barrier 48 inches or taller, measured from the ground outside it
- A bottom gap no taller than 2 inches
- Spacing tight enough to block a 4-inch sphere
- Walk gates hinged to open away from the water, with self-closing and self-latching hardware and room for a lock
- A latch release less than 54 inches above the bottom of the gate placed on the pool side, at least 3 inches below the top, with no opening over 1/2 inch within 18 inches of it
- Where a wall of the house is part of the barrier, an alarm on doors that open to the pool, or another option the code lists
Pools with a powered safety cover, and spas or hot tubs with a lockable safety cover, meeting ASTM F1346 do not need the barrier.
A town without its own code or inspector still falls under the state code (71-6406(7)), so the barrier rule applies even if no one checks it.
City Variations in Nebraska

Above-Ground Pools in Nebraska
Under the ISPSC model text, an above-ground pool wall can serve as the barrier if it meets the height rule, and a ladder or steps must be removable, lockable or surrounded by a compliant barrier (ICC). Ask your building department how your local code treats above-ground pools before you buy.
