West Virginia Pool Barrier Law
West Virginia has a State Building Code, but it applies to a home only where the county or city has adopted it. The State Fire Commission's rule, 87CSR4, incorporates the 2018 International Residential Code (IRC) and the 2018 International Swimming Pool and Spa Code (ISPSC). Each county or city that adopts the code notifies the Fire Commission and enforces it under W. Va. Code 7-1-3n (counties) and 8-12-13 (cities), and code appendices apply only if the jurisdiction adopts them. The current rule took effect August 1, 2022 and is set to expire August 1, 2027 unless replaced.
Where the code is adopted, ISPSC Section 305 sets these barrier rules (ICC model text; West Virginia adopts the 2018 edition):
- Height: 48 inches or more, measured outside the barrier
- Bottom gap: 2 inches at most over soil, grass or gravel
- Openings: none a 4-inch ball can pass through
- Gates: open outward, swing shut and latch by themselves, and accept a lock
- Latch: a release under 54 inches goes on the pool side, 3 inches below the top, with nothing over 1/2 inch open within 18 inches of it
- House wall: where it forms part of the barrier, doors to the pool need an alarm or another option the code allows
Pools with a powered safety cover, and spas or hot tubs with a lockable safety cover, meeting ASTM F1346 do not need the barrier.
Permits in West Virginia
Where a county or city has adopted the State Building Code, its building department issues permits and inspects under it (87CSR4). Where it has not, the state code does not apply to your home, and there may be no permit process at all. Ask your county or city which applies to your address.
Above-Ground Pools in West Virginia
In a county or city that has adopted the code, the ISPSC allows an above-ground pool's wall to serve as the barrier when it sits on grade, stands at least 48 inches high all around, and its ladder or steps can be secured, locked or taken away.
