South Dakota Pool Barrier Law
South Dakota has no statewide building code for homes and no statute requiring a pool fence. Instead, state law sets the terms for local codes, most recently updated by 2026 Senate Bill 129:
- A city may regulate one- and two-family homes, townhouses and their accessory structures by adopting the 2024 International Residential Code (IRC), and may amend it (SDCL 11-10-12).
- A city may not require fire sprinklers in those homes or impose any requirement more stringent than the 2024 IRC (same section).
- For other buildings, a local code must follow the 2024 International Building Code (IBC); where there is none, the 2024 IBC is the design standard for work begun after July 1, 2026, but not for homes, manufactured homes or farmsteads (SDCL 11-10-5, 11-10-6).
The IRC's pool section sends pools to the International Swimming Pool and Spa Code (ISPSC). Where a city's code includes it, Section 305 sets these rules (ICC model text, 2024 edition):
- Height of 48 inches or more on the outside face
- A 2-inch maximum gap under the barrier over grass or gravel, 4 inches over concrete
- No openings that pass a 4-inch sphere
- Gates that open outward and close and latch by themselves, with a way to lock them
- Any latch release lower than 54 inches kept on the pool side of the gate
- Door alarms or another listed option where the home's wall is part of the barrier
A pool with a powered cover, or a spa or hot tub with a lockable cover, listed to ASTM F1346 is exempt from the barrier.
The State Cap on City Codes
Because of SDCL 11-10-12, a South Dakota city's residential rules have a ceiling as well as a starting point: a city can adopt and amend the 2024 IRC, but the statute bars requirements more stringent than it (SB 129, Section 4). How a city applies that to a pool barrier is a question for its building official.
Where a city has not adopted the IRC, no state residential code fills the gap: the state's fallback design standard does not cover homes (SDCL 11-10-6). In those places, state law may require no pool barrier at all.
Above-Ground Pools in South Dakota
If your city's code carries the ISPSC, the side of an above-ground pool may be the barrier once it reaches 48 inches everywhere and the entry ladder or stairs can be removed, locked or enclosed. Your city's building office can say whether that applies.
