Wyoming Pool Barrier Law
No Wyoming statute requires a fence around a pool at a private home, and the state has no residential building code. The Council on Fire Prevention and Electrical Safety adopts the 2024 International Building Code (IBC), the fire code and related codes, and takes in the International Residential Code (IRC) only where those codes refer to it (041-1 Wyo. Code R. 1-2). The state fire marshal's plan review covers buildings owned or leased by state and local government, public buildings over 5,000 square feet, and places such as restaurants, churches and meeting halls, not private houses (W.S. 35-9-108). The state does not require cities or counties to adopt a code at all (International Code Council (ICC) Wyoming page).
Where a city or county has adopted the IRC, the code's pool section sends pools to the International Swimming Pool and Spa Code (ISPSC). Section 305 of that model code calls for (ICC model text, 2024 edition):
- A barrier 48 inches tall or more, measured on the side away from the pool
- No more than 2 inches of clearance at the bottom over soil or gravel, 4 inches over paving
- No gap a 4-inch sphere can pass through
- Gates that swing outward, close and latch by themselves, and can take a lock
- Construction fencing at least 4 feet high around an in-ground pool site from excavation until the permanent barrier is finished
- Door alarms or another approved option where a house wall forms part of the barrier
Public pools are the one place state rules set a barrier. Department of Agriculture rules require an enclosure at least 4 feet high with no more than 4 inches below it, and self-closing gates with a lockable, self-latching device at least 42 inches above the ground (010-3 Wyo. Code R. 3-29). They do not reach a pool at a private home.
Casper adopted the 2024 International Codes, including the 2024 IRC (Ord. 17-24, August 2024), with local amendments (City of Casper); ask the city whether its amendments change the pool section. Counties and cities that hold state-delegated enforcement authority must keep their codes at least as strict as the state's (W.S. 35-9-121). Laramie County, for example, issues permits in its unincorporated area and gave notice in October 2024 that it would adopt the 2024 codes (Laramie County). Elsewhere your city or county may enforce no residential code, so ask before assuming either way. Ask your building department what depth it expects for fence and gate posts.
Teton County and Jackson
Teton County enforces building and fire codes under authority the state delegates, and to keep that authority it must adopt standards at least as strict as the state's within six months of each state update (Teton County staff report, Nov 2024). If your property is in Teton County or the Town of Jackson, start with the county or town building department for permits and the residential code edition in force.
Above-Ground Pools in Wyoming
Where a local code includes the ISPSC, the barrier rules apply to pools holding more than 24 inches of water. An above-ground pool's own wall can serve as the barrier if it is at least 48 inches high all the way around and its ladder or steps can be removed, locked or fenced. Where your city or county enforces no residential code, ask whether any local ordinance applies before you set up.
